Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Mingle254 website, mobile application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You may use the Service only if you are legally permitted to do so under the laws applicable to you and you meet our minimum age and account eligibility requirements. By using the Service, you represent that the information you provide is accurate and that you are legally allowed to enter into these Terms.

The Service is intended only for adults aged 18 and over. Minors are not permitted to create accounts or use the Service.

2. Account Registration and Security

You are responsible for keeping your login credentials secure and for activity that occurs under your account. You must provide accurate information when registering and keep your information reasonably up to date.

You may not transfer your account to another person, share access in a misleading way, or create an account on behalf of another person without authorization.

3. Acceptable Use

You agree that you will not use the Service to:

• impersonate another person or misrepresent your identity, age, relationship status, or intentions;
• harass, threaten, abuse, exploit, stalk, intimidate, or extort another user;
• send spam, scams, deceptive messages, phishing attempts, or fraudulent requests;
• upload, post, or transmit unlawful, harmful, misleading, or abusive content;
• share content that violates another person’s privacy, rights, or applicable law;
• use the Service for commercial solicitation unless expressly authorized by us;
• attempt to access accounts, systems, or data without authorization;
• interfere with the operation, integrity, or security of the Service;
• use automated means, scraping, bots, or other unauthorized tools to access or collect information from the Service;
• circumvent blocks, suspensions, safety controls, or enforcement measures.

4. User Content

You remain responsible for the content, messages, media, profile information, and other material you upload, post, transmit, or otherwise make available through the Service ("User Content"). You represent that you have the right to provide that content and that it does not violate law or these Terms.

You grant us a limited, non-exclusive, revocable, worldwide right to host, store, process, reproduce, display, and use User Content only as reasonably necessary to operate the Service, improve functionality, enforce these Terms, investigate abuse, protect users, and comply with law.

5. Safety, Reporting, and Moderation

We may provide features allowing users to block, report, mute, or otherwise restrict interactions. Users are encouraged to report suspicious, abusive, fraudulent, exploitative, or otherwise harmful conduct.

When a report is made, we may review profile information, messages, uploads, recent interactions, internal account history, and related evidence as reasonably necessary to assess the report and protect users. We may keep moderation records for safety, enforcement, legal, and audit purposes.

We may take action on accounts or content where we reasonably believe it is necessary to protect users, investigate abuse, enforce our rules, preserve platform integrity, or comply with legal obligations. Such actions may include warnings, content removal, feature restrictions, blocking effects, temporary suspension, or permanent account termination.

6. No Guarantee of Matches, Availability, or User Conduct

We do not guarantee matches, responses, conversations, compatibility, relationship outcomes, or the behavior, identity, intentions, truthfulness, or safety of any user. You are responsible for using good judgment and taking appropriate precautions when interacting with others, online or offline.

7. Account Suspension, Restriction, and Termination

We may suspend, restrict, deactivate, or terminate any account, or remove content, with or without notice where reasonably necessary to protect users, investigate violations, prevent abuse, reduce legal risk, preserve platform integrity, or comply with applicable law or lawful requests.

We may also refuse to restore accounts where we determine that doing so may create safety, fraud, compliance, or operational concerns.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data.

9. Third-Party Services

The Service may rely on or link to third-party services, infrastructure, tools, stores, payment systems, hosting providers, or websites. We are not responsible for third-party services except as required by law.

10. Disclaimers

To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, complete accuracy, or that the Service will always be secure or free from harmful components.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Mingle254 and its operators shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising out of or related to the Service, user conduct, user content, third-party conduct, or unauthorized access, except where liability cannot lawfully be excluded.

12. Indemnity

To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, and costs arising from your unlawful use of the Service, your violation of these Terms, or your infringement of another person’s rights.

13. Changes to the Service or Terms

We may update, modify, suspend, or discontinue any part of the Service and may revise these Terms from time to time. Where appropriate, we will update the "Last updated" date and may provide additional notice.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable in Kenya, unless otherwise required by mandatory law applicable to you.
